Terms of use of the SuperSitter platform

 

1. DEFINITIONS

 

1.1. Administration. It consists of persons responsible for managing the SuperSitter page. The administrator performs administrative duties on the SuperSitter page and acts as an intermediary for users. The administrator of supersitter.com.ua is Family Projects Oy. Kasavuorentie 18A4, 02700 Kauniainen, Finland.

 

1.2. Anonymous user. A person who uses the management services of the website without registering on the website.

1.3. Personal data. Any information that can be used to identify an individual; as well as any information about a person whose identity has already been identified.

1.4. Website. The www.supersitter.com.ua website managed by the administration.

1.5. Membership fee. A fixed fee established by the administration. Users paying a fixed fee have the opportunity to use additional functions of the SuperSitter platform.

1.6. Privacy Policy. The procedure presented on the website for the processing of personal data, which the user submits to the administration via the website. The SuperSitter platform user agrees to the processing of personal data and confirms that all personal data and information provided by him are true and correct.

1.7. SuperSitter platform. A system owned by the administration and managed and maintained by the administration. The system is located on a website through which users can find an assistant/service provider (babysitter, domestic helper, pet sitter or home tutor) or a suitable assistant job.

1.8. Rules. The rules for using the SuperSitter platform, which are regulated by the SuperSitter terms of use, legal relations between website users and the administration, as well as legal relations between users. The user who wants to use the services provided by the administration must agree to the rules.

1.9. User. A natural person of at least 18 years of age who has registered on the website with the aim of finding an assistant or a job.

1.10. User profile. This is a record of a user registered on the SuperSitter platform, which consists of personal data entered by the user about himself.

 

2. WORKING PRINCIPLES OF THE SUPERSITTER PLATFORM

 

2.1. On the SuperSitter platform, the administration helps users to cooperate. Users can find a helper, the helper can find a job. Administration acts as an agent between users.

2.2. The administration, as the owner of the website and the SuperSitter platform, does not act as an assistant and does not look for assistants. Only users are responsible for entering information in advertisements and providing assistance services.

2.3. Users understand and agree that they alone are responsible for complying with the legislation applicable to their activities. Users of the SuperSitter platform understand that when hiring people and providing services, they may be required to have certain permits and licenses that allow them to comply with the formalities of the employment relationship and to perform other legal and/or tax actions prescribed by the legislation of the Republic of Ukraine.

2.4. The information and personal data on the website and in the advertisements are entered by the users themselves, therefore the administration is not responsible for the correctness and correspondence of this information to reality, nor for damages or possible damages caused by the actions of users, agreements and contracts concluded on the basis of the information displayed on the website.

 

3. REGISTRATION PROCESS AND WEBSITE TERMS OF USE

 

3.1. An anonymous user can view ads and user profiles. The visibility of information on user profiles is limited to anonymous users.

3.2. A person who wants to use the SuperSitter services in full must register on the SuperSitter website using one of the following methods:

3.2.1. by filling out the corresponding registration form on the website;

3.2.2. by logging in with a Facebook profile.

3.3. The user has the right to add only his own photo as a user profile photo. It is prohibited to include graphic images/letters/numbers (for example, logos, handwritten notes, phone numbers, surnames, keywords) or photos combined with graphic images/letters/numbers or modified in any other way. By uploading photos to the profile, the user confirms that he has the right to use the photos, which do not violate the rights of third parties.

3.4. Registered users can post ads and add information to their user profile. They also see more information than anonymous users and can exchange private messages with other users (as defined on the website). The full functionality of the page can be used by users who pay a membership fee according to a fixed system.

3.5. When registering, the user creates personal login data (username and password) and is obliged to keep the given data secret and not to disclose it to third parties. To reduce the risk of illegal login on behalf of the user on the SuperSitter platform, it is recommended to create a strong and hard-to-guess password (it is recommended that the password should consist of at least eight symbols, contain both upper and lowercase letters, numbers and punctuation marks, and avoid easily guessed words (user's first name, last name, etc.) and/or numbers (for example, birthday, etc.) and the password should be changed at least every six months. The user is responsible for the strength and storage of the login data created by him and for other possible activities (data transfer, posted offers, user comments, etc.) that are performed when logging in to the website using the user's login data. If a third party logs in to the SuperSitter page with the user's login data, the administration considers this person a user. If the user has lost his login data, he should immediately notify the SuperSitter administration either by e-mail or change the login data by logging into the platform.

3.6. The user is obliged to provide correct, factual and detailed data on the registration form. If the personal data provided on the registration form has changed, the user should update it immediately. The administration is not responsible for incorrect or inaccurate personal data entered by the user or third parties, or for personal data that has not been changed or supplemented.

3.7. The user has the right to change, supplement or delete registration data at any time. When the registration is deleted, the user loses the opportunity to use the SuperSitter platform in full. The user can restore the usage options only by re-registering on the SuperSitter page.

3.8. By registering on the website, the user confirms that he is at least 18 years old.

3.9. Users who have paid the fixed membership fee in advance by following the procedure outlined on the website can use the most extensive options of the website (the scope is defined on the website). The membership is valid for the period for which it has been paid for, unless it is desired to terminate the membership early according to the rules of the procedure.

3.10. The membership is automatically renewed for the period valid at the time of renewal and the corresponding payments are automatically debited from the user's bank account, unless the user informs of the cancellation of the membership or does not wish to renew it before the end of the membership.

3.11. The user can cancel the membership at any time using one of the following ways: i) through the user account on the SuperSitter website ii) by informing the administration at [email protected] iii) if the user paid for his membership via Paypal - via the Paypal system. If the user cancels the membership, the membership fee is not refundable.

3.12. The administrator has the right to change membership plans and membership fees. Changes take effect after the user has been notified of the respective changes.

 

4. RIGHTS AND OBLIGATIONS OF USERS

 

4.1. SuperSitter platform user should:

4.1.1. not to commit illegal activities on the website;

4.1.2. communicate with other users and the administration in accordance with universally accepted principles of ethics and morality;

4.1.3. to transmit only correct information to other users and the administration and to constantly update their own data.

4.1.4. act fairly, without the intention of deceiving another user and/or the organizer;

4.1.4. change your login data if there is a risk that the data may have become known to third parties;

4.1.5. ensure that the information and photo on the user's profile meet the requirements of morality and ethics and do not infringe anyone's copyright or cause disagreements in any other way or for any reason;

4.1.6. ensure that the information entered i) corresponds to the purpose of using the SuperSitter platform; ii) does not promote any person or product without the prior consent of the administration; iii) does not threaten the operation of the SuperSitter platform or its database (for example, programs or documents infected with a virus).

4.2. The administration has the right to limit the user's opportunities to use the website, including removing the user completely from the website and taking other actions deemed necessary by the administration, including but not limited to suspending the rights and obligations of the person acting as an administrator, if the administration's action or inaction is necessary for the unconditional functioning of the website and/ or to ensure the rights of other users.

4.3. The administration has the right to suspend the user's registration and/or delete the user from the website and/or block the user in the following cases:

4.3.1. the user has entered or is entering incorrect, false and/or incomplete information;

4.3.2. the user's behavior with other users does not correspond to universally accepted moral principles;

4.3.3. the user uses the SuperSitter platform to intentionally harm other users and/or the administration;

4.3.4. the user otherwise violates these rules or applicable laws.

4.4. The administration owns the intellectual rights of the website, its domain (SuperSitter) and the operating system. The user is forbidden to save, copy, move, move, transfer and disclose the content of the website.

 

5. LIMITATION OF LIABILITY

 

5.1. The administration cannot and does not have to be responsible for the damage caused to the user when a third party logs in to the SuperSitter platform using the user's login data.

5.2. The administration is not responsible for third-party advertisements, links or cookies on the website. The user should consider the user agreements and privacy policies of third parties.

5.3. Due to the peculiarities of the Internet as an external factor, the administration cannot guarantee uninterrupted access to the website. The organizer may restrict access to the SuperSitter platform in whole or in part if it is necessary due to security, server maintenance or other objectively important reasons.

5.4. The administration has the right to change the content or functions of the website without prior warning to users. The administration has the right to change the provision of services or terminate the provision of services for any reason and without prior warning, including the right to terminate the provision of services to any user or third party either with or without prior warning and liability to users.

 

6. FINAL PROVISIONS

 

6.1. The administration has the right to change the rules unilaterally, and if significant changes should be made to the rules, the administration has the right to inform the user of these changes either through the website or through the contact data entered by the user. The change in the rules will enter into force five working days after it is published on the website or users are notified by e-mail. The change will apply to all users who did not express their disapproval of the change within the specified time period.

6.2. The rules have been drawn up in accordance with the laws of the Republic of Ukraine.

6.3. The laws of the Republic of Ukraine apply to relations arising from the implementation of the rules.

6.4. All disagreements arising from the implementation of the rules will be resolved through negotiations. If an agreement is not reached, the disputes will be settled in the courts of the Republic of Ukraine according to the procedure specified in the legislation.

PRIVACY POLICY

 

1. PURPOSE OF THE PRIVACY POLICY

 

1.1. This privacy policy explains the rights of users and the principles and purposes of personal data processing on the website.

1.2. A privacy policy has been drawn up and personal data entered on the website is managed in accordance with the requirements determined by the laws and regulations of the Republic of Ukraine.

1.3. By entering their personal data on the website, the user agrees that personal data will be managed in accordance with the procedure set out in this privacy policy.

 

2. DEFINITIONS

 

2.1. Different terms are used in this privacy policy. The meaning of the terms is explained below:

Personal data, or data, is any information about a user whose identity has been identified or whose identity can be directly or indirectly identified (data subject).

Data processing is any operation or sequence of operations (for example, data collection, storage, sorting, systematization, storage and other operations) performed using automatic or non-automatic tools and during which personal data or part of personal data is processed.

A personal data processor is a natural and legal person who processes personal data on behalf of the data controller.

The controller manages the website and its address is www.supersitter.com.ua

SuperSitter platform. A system managed and administered by the controller. The system is located on a website that allows users of the platform to find helpers (babysitter, domestic helper, pet sitter, home teacher or other helper) or a suitable job as a helper.

The privacy policy is this privacy policy, which sets out the main rules for the data controller resulting from the collection, accumulation, management and storage of data and which are applied to the users of the website.

Regulation means Regulation 2016/679, which entered into force on 25 May 2018 throughout the European Union. The Regulation deals with the protection of personal data of natural persons through the management of personal data and the free movement of such data; through the regulation, Directive 95/46/EC is considered null and void.

A user is a natural person who visited the controller's website and registered on it by entering his personal data.

 

3. PERSONAL DATA PROCESSING

 

3.1. A person wishing to register on the website should provide (in other cases, the user can provide) the following personal data to the controller: i) name, surname; ii) date of birth; (iii) gender; iv) email address; v) telephone number; vi) location/place of service provision; vii) photograph; viii) data obtained when connecting to a Facebook profile. In addition, the data processor processes other personal data. Corresponding data has been entered by the user on the SuperSitter platform by posting advertisements or in other ways.

3.2. The controller has the right to use non-personal data of users for the purpose of data analysis, using various statistical methods, with the aim of conducting statistical and financial analysis, improving the quality of services, etc. The controller has the right to disclose the results of such impersonal statistical analysis, use it for marketing and other purposes.

3.3. The controller can also use cookies on the website, which are used to study the specifics of the use of the website, user behavior or automatically compiled visit statistics.

3.4. The controller also processes the personal data of the purchased membership and the activities on the SuperSitter platform.

 

4. PURPOSES OF PERSONAL DATA PROCESSING

 

4.1. Personal data entered by users is processed for the following purposes:

4.1.1. Provision of services. The controller collects users' personal data and uses them to mediate assistants and assistant seekers on the SuperSitter platform.

4.1.2. Website Improvement. The controller collects data on website usage statistics and behavior of users in order to evaluate the functionality of the website and to improve the accessibility of the services and increase the ease of use.

4.1.3. Getting in touch. The controller can contact users and answer their questions.

4.1.4. Direct marketing. If the user consents to receive offers and news, the controller uses personal data to send offers and information (for example, general newsletters, information about offers, news, discounts, asking for opinions about the services offered) to the user. The user has the right to opt out of receiving offers at any time and can revoke his consent at any time. Opting out of offers does not prevent the user from using the SuperSitter platform.

4.1.5. User identification. The user's personal data is used to identify the user and to make sure that the person is not younger than 18 years.

 

5. DISCLOSURE OF PERSONAL DATA

 

5.1. The user confirms that he understands that personal data entered during registration and in advertisements are publicly available to other persons.

5.2. The data controller ensures that users' personal data is not sold, used or transferred in any other way to third parties without a legal basis, nor is the data used for a purpose other than that for which it was collected. The controller transmits data only in compliance with this privacy policy and the laws of the Republic of Ukraine.

5.3. In addition to the cases specified in the privacy policy, the data controller may transfer users' personal data to third parties only in the following cases:

5.3.1. The data controller for service providers who cannot find out the user's data (accounting and IT service providers, lawyers, courts, bailiffs, debt collection companies, database administrators, etc.) due to the specifics of the services they provide.

5.3.2. if the user gives separate consent to the transfer of data;

5.3.3. in the cases prescribed by law and if it is necessary to achieve the goals outlined in this privacy policy;

5.3.4. Transfer of data is mandatory if required by law enforcement authorities in accordance with the procedure specified in the legislation of the Republic of Ukraine;

5.3.5. in other cases, which are based on the legislation of the Republic of Ukraine.

 

6. USE OF COOKIES

 

6.1. The controller may use cookies on the website. Cookies are text files with a unique identification number, which are saved from the website to the hard drive of the user's computer, so that the controller can distinguish the user's computer and see its activity on the website.

6.2. With the help of cookies, the controller collects the following personal data: type of web browser, demographic data, IP address, etc.

6.3. The controller uses the data obtained from website cookies to identify users, analyze website visit statistics and user behavior, and improve the quality of the website.

6.4. The user can change the settings for the use of cookies (delete/block all cookies or some of them) by changing the settings of his web browser. 7. DATA STORAGE TERMS

 

7.1. The data controller stores the user's personal data during the time period prescribed by the laws of the Republic of Ukraine and other valid laws and this privacy policy, but no longer than is necessary to achieve the data processing goals outlined in this privacy policy.

7.2. The controller processes the user's data as long as the user has an existing profile on the SuperSitter platform. If the user deletes his profile on the SuperSitter platform, the controller stores the user's personal data within one month from the deletion of the user's profile. Paid membership data is stored for five years until the membership expires. In some cases, personal data may be stored longer, for example, if it is necessary to resolve disputes or in other cases.

7.3. The controller does not store irrelevant and outdated personal data, and if the user updates the data in his account, the old information will be replaced with new information. Historical information is stored if it is necessary for legislative proceedings or for the controller to carry out its activities, no longer than necessary.

 

8. RIGHTS OF USERS

 

8.1. By using the website, users have the right to:

8.1.1. to know what personal data is used and for what reason;

8.1.2. access your personal data;

8.1.3. request correction or addition of personal data if it is inaccurate or irrelevant.

8.1.4. request deletion of personal data (right to be forgotten);

8.1.5. require the controller to limit the use of the user's personal data;

8.1.6. to request the transfer of data to another data controller (right to transfer).

8.2. The user has the right to submit all requests related to the privacy policy to the data controller in writing, using the contact details provided at the end of this privacy policy.

8.3. The user should provide his/her identity document or identify himself/herself using electronic means of communication, the use of which is permitted when making the request.

8.4. The controller responds to the user's request and performs the actions specified in the request or refuses to perform them, stating the reason for the refusal no later than within 30 days from the day the request was sent. Taking into account the complexity of the requests, the specified period can be extended by two months. In this case, the data controller informs the user of the corresponding extension and provides the reasons for the delay.

8.5. If the user submits a request to delete their personal data, the data controller is obliged to delete them if the request is based on at least one of the following reasons:

8.5.1. Personal data are no longer necessary to achieve the purposes for which the data were collected or otherwise managed;

8.5.2. The user withdraws his consent, on the basis of which personal data is processed, and there is no other legal basis for processing the user's personal data;

8.5.3. The user does not agree to data processing if the legitimate interests of the data controller have a basis and the data controller does not provide better legal reasons for further data processing;

8.5.4. Personal data was processed illegally;

8.5.5. Personal data should be deleted in accordance with the requirements established by the laws of the European Union and the Republic of Ukraine.

8.6. The controller restricts the processing of the user's personal data in the following cases:

8.6.1. the user disputes the correctness of personal data; data processing is limited to a period of time when the data controller checks the legitimacy of personal data;

8.6.2. The processing of personal data is illegal, and the user refuses to delete personal data, wanting to limit the use of the data instead;

8.6.3. The controller does not need personal data for the purposes specified in the fourth chapter of this privacy policy, but the user needs the data to demand, exercise or protect his legal rights.

8.6.4. The user objected to the processing of personal data based on the legal interests of the controller; data processing is limited until it is checked whether the controller's legal rights outweigh the user's reasons.

8.7. If the user exercises his right to delete or restrict data, access to the SuperSitter platform may be impossible or limited.

8.8. If the user exercises his right to data transfer, he can request the responsible processor to send his personal data directly to another personal data processor, if this is technically possible.

8.9. The controller has the right not to satisfy the user's requests, with the exception of the request to refuse direct marketing offers and the request to settle the disagreement with an out-of-court solution, if it has to ensure: (i) the fulfillment of the legal obligations prescribed for the controller; (ii) public order or crime prevention; (iii) protection of the rights and freedom of users or others; or (iv) in other cases provided for in subsection 1 of Article 23 of the Regulation.   In any case, the controller who refused to fulfill the user's request should indicate the reasons for the refusal.

8.10. If the user notices the illegal processing of his data or if a dispute arises with the data controller, the user has the right at any time to turn to the out-of-court settlement institution in Ukraine, using the procedure shown on the website of the Data Protection Inspectorate https://iki-ukraine.org/data-protection/

 

9. CHANGES TO THE PRIVACY POLICY

 

9.1. The controller has the right to update and change the provisions of this privacy policy.

9.2. If significant changes have been made to the privacy policy, the controller has the right to inform the user of the corresponding changes through the user's specified contact details and/or website. The published privacy policy change comes into effect five working days after it is published on the website or sent to users by e-mail. The change will apply to all users who did not express their disapproval of the change within the specified time period.
